Lee Moser, charged with 8 counts in Nassau, faces potentially 7 years

MINEOLA –

A Smithtown-based contractor accused of scamming Superstorm Sandy victims out of thousands of dollars has now been charged in Nassau County.

Lee Moser, of Capstone Remodeling, was hired to repair homes in the wake of Sandy. Homeowners in Suffolk and Nassau say Moser took thousands of dollars from them, then either didn’t do or finish the work.

Moser was arrested in October in Suffolk County on fraud and grand larceny charges.

According to Nassau District Attorney Madeline Singas, Moser stole $113,485 from five complainants. She says he “allegedly spent the money on gasoline, restaurants, telephone service and other expenditures to continue running his business unrelated to the homeowners’ respective contracts.”

His attorney told News 12 in November that Moser intended on paying all the money that was owed to victims.

Moser, 49, was charged Tuesday with five counts of grand larceny in the third degree, scheme to defraud in the first degree and two count of operating a home improvement business without a license. His bail was set at $5,000 bond or $2,000 cash. He is due back in court on Jan. 23.

Moser faces up to seven years in prison if convicted on the top counts.
